| 6. | The seller shall not be held responsible for delay in shipment or non - delivery of the contract goods due to force majeure such as war , serious fire , flood , typhoon , earthquake or other cases which are agreed upon by both parties as the cases of force majeure
由于人力不可抗事故（如战争、严重火灾、水灾、台风、地震和其它双方认定的人力不可抗事故） ，卖方交货延迟或不能交货的，责任不在卖方。 |
| 7. | Article 118 duty to notify in case of force majeure if a party is unable to perform a contract due to force majeure , it shall timely notify the other party so as to mitigate the loss that may be caused to the other party , and shall provide proof of force majeure within a reasonable time
第一百一十八条当事人一方因不可抗力不能履行合同的，应当及时通知对方，以减轻可能给对方造成的损失，并应当在合理期限内提供证明。 |
| 8. | Should anything happen which prevents either party from executing the contract which could not be controlled , avoided and overcome , such as war , serious fire , typhoon , earthquake , floods and other cases , the concerned party shall notify the other party by fax or telex within the shortest possible time and send by registered airmail to the other party a certificate issued by competent authorities for confirmation within fourteen ( 14 ) days following the occurrence of the case of force majeure
如果发生任何不能控制、不能避免并且不能克服的事件防碍任何一方对本合同的履行，诸如战争、重大火灾、台风、地震、水灾和其他事件，受到影响的一方应在尽可能短的时间内以传真或电传通知另一方，并且应在该等不可抗力事件发生后14天内以挂号航空的方式向另一方发出一份由主管机关出具的证明加以确认。 |
| 9. | If , at any time during the execution of the contract , either of the parties to the contract is prevented from executing the contract in cases of force majeure such as war , serious fires , flood , typhoon and earthquake , etc . , the time for execution of the contract shall be extended for a period equal to the affect of those causes
在合同期的任何时候，合同双方的任何一方，由于受到如战争、严重火灾、洪水、台风、地震等不可抗力事件的影响而不能执行合同时，履行合同的期限应予以延长，延长的期限应相当于事件所影响的时间。 |
